Terms of Service & License

1. Accepting these terms

These Terms of Service ("Terms") are an agreement between you and Stonefly Labs, LLC ("Stonefly Labs", "I", or "me") governing your use of my apps and this website. By downloading, installing, or using a Stonefly Labs app, you agree to these Terms. If you don't agree, please don't use the apps.

2. Your license to use the apps

I grant you a personal, non-exclusive, non-transferable, revocable license to download and use Stonefly Labs apps on Apple devices you own or control, in line with the Apple Media Services Terms and the Usage Rules in Apple's App Store terms. This license is for your own non-commercial entertainment.

3. What you can't do

You agree not to:

• Copy, distribute, sell, rent, or sublicense the apps.
• Reverse-engineer, decompile, or attempt to extract the source code, except where the law expressly allows it.
• Modify or create derivative works of the apps.
• Use the apps in any unlawful way or to infringe someone else's rights.

4. Ownership

The apps, including their code, art, characters, music, and the Stonefly Labs name and logo, are owned by Stonefly Labs, LLC and are protected by intellectual-property laws. Your license doesn't transfer any ownership to you.

5. Purchases & refunds

Any paid apps or in-app purchases are sold and processed by Apple, and are subject to Apple's terms. Refund requests are handled by Apple through your Apple Account. If an app has no purchases, this section simply won't apply to it.

6. No warranty

The apps are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. I work hard to make the games stable and fun, but I can't guarantee they'll always be error-free or uninterrupted.

7. Limitation of liability

To the fullest extent permitted by law, Stonefly Labs won't be liable for indirect, incidental, or consequential damages arising from your use of the apps. Where liability can't be excluded, it is limited to the amount you paid for the app in question (which may be nothing).

8. Apple-specific terms

Because the apps are distributed through the App Store, the following apply:

• These Terms are between you and Stonefly Labs only, not with Apple. Apple is not responsible for the apps or their content.
• Apple has no obligation to provide maintenance or support for the apps.
• If an app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the apps, including product-liability, legal/regulatory, or intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
• You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

9. Termination

This license lasts until terminated. It ends automatically if you break these Terms. You can end it any time by deleting the apps. Sections that by their nature should survive — like ownership, disclaimers, and liability — will continue to apply.

10. Governing law

These Terms are governed by the laws of the state in which Stonefly Labs, LLC is organized, without regard to conflict-of-laws rules. [Insert your state — e.g. "the State of Oregon" — before publishing.]
